1. Introduction
Welcome to MUUVR! MUUVR is a fitness platform by Muuvr Labs AG, based in Zurich, Switzerland (the «Company»). MUUVR aims to motivate people to live a more active life.
These Terms of Use (“Terms”) between you and the Company govern your use of MUUVR, including all services, features, and content available through the platform. Please read them carefully before using the platform. By using MUUVR, you agree to these terms.
2. Overview
Muuvr connects you and all users with a community of other fitness enthusiasts, while also allowing you to track your own workout activities. The platform includes features like leaderboards, challenges, and incentives to keep users motivated and engaged.
Muuvr is available for both Android and Apple smartphones and can be connected to data collection devices and platforms, known as wearables, including Garmin, Apple, Google, Wahoo, and Whoop.
MUUVR accesses the user data from your respective wearable app. When installing the MUUVR app on your smartphone, you must give your consent for MUUVR to work as intended automatically. MUUVR only has access to the data you record on your wearable app. Please also carefully review our privacy policy, which forms an integral part of these terms.
Through athletic and other activities listed under section 4.3., you can collect points with MUUVR. Once the connection between the MUUVR app and your wearable app is established, the number of new MUUVS is continuously calculated. As part of a company rewards program, you can use your MUUVS alone or with a payment method to gain access to and discounts on unique goods, services, vouchers, or coupons from independent merchants, purchase or enter sweepstakes. 3. Using MUUVR
3.1 Requirements for Use
To use MUUVR, you need to meet certain requirements. By using MUUVR, you confirm that you meet the following criteria:
You must be capable of making decisions to be allowed to use MUUVR. To enter into contracts within the Reward Program, you need to be at least 18 years old and legally able to act according to your country's regulations. If you are not legally able, you can only use the Reward Program together with and with the consent of a parent or guardian.
You are not allowed to use MUUVR if it is legally prohibited for you to receive the services offered by MUUVR or to use the software.
MUUVR reserves the right to deny access to or use of the platform at any time and for any reason at its sole discretion. There is no legal claim to admission to MUUVR.
3.2 License to Use the Services
The company grants you a limited, non-exclusive, non-transferable, and revocable license to use MUUVR, subject to these conditions.
The company reserves the right to terminate your license to use the platform at any time and for any reason at its sole discretion.
3.3 Prohibited Use of MUUVR
You may use MUUVR only for personal, non-commercial purposes.
When using MUUVR, you must not:
violate applicable laws or regulations;
use MUUVR for illegal or unauthorized purposes;
infringe on the intellectual property rights of others;
upload, publish, or transmit content that is illegal or offensive, especially content that is defamatory, libelous, glorifies violence, is racist, pornographic, or harmful to minors;
impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;
actively or passively engage in activities that could harm or exploit minors;
transmit viruses or other harmful software; or
actively or passively engage in actions that could disrupt or interrupt MUUVR, its servers, or networks.
3.4 Keeping the Company Harmless and Blocking the MUUVR App
You agree to indemnify the company from any claims, damages, or losses arising from non-compliance with laws, regulations, or these terms. Whether these are claims, damages, or losses that occur directly to the company or from harmed third parties wanting to access the company.
The company reserves the right to remove content that violates the law, good morals, or these terms. Furthermore, the company can pause or terminate your Muuvr app at any time or take other appropriate actions at its discretion if you violate the law, good morals, or these terms.
The company also encourages all users to report violations of the law, good morals, or these terms to info@muuvr.io The company will, to the best of its knowledge and belief, investigate all reports and, if necessary, take appropriate actions at its discretion.
3.5 User Content
MUUVR lets you upload and share content, including but not limited to information, data, texts, software, sounds, photos, graphics, videos, messages, posts, tags, or other materials (“User Content”). By uploading User Content to MUUVR, you grant the company a non-exclusive, transferable, sublicensable, royalty-free, worldwide, unlimited license to use it in any way, particularly to copy, modify, distribute, publicly display, and create derivative works based on your User Content. You also give MUUVR the right to use, display, and distribute your User Content for providing and promoting the platform.
3.6 Ownership of User Content
You retain all ownership rights to your user content. The company does not claim any ownership rights to this content.
3.7 Assurance
By uploading user content to MUUVR, you declare and guarantee that:
you are the owner of the user content you provide in connection with MUUVR, whether it is publicly posted, privately transmitted, or submitted via a third-party API (e.g., a video submitted via Zwift), or you otherwise have the right to grant the rights and licenses set forth in these terms;
the user content does not infringe on the rights of third parties, especially their privacy rights;
the user content does not violate the law or public morals, and in particular, the user content is not defamatory, libelous, violent, racist, pornographic, or harmful to minors; and
the user content does not contain viruses or other harmful software.
You agree to indemnify the company, its board members, executive officers, agents, employees, partners, and licensors against any claims or demands made by a third party due to or arising out of the user content you provide over MUUVR, your use of MUUVR, your athletic activities from which the user content you publish on MUUVR now or in the future is generated (this includes, among other things, athletic activities as part of competitions, races, group rides, or other events sponsored or organized by MUUVR, in which MUUVR is involved, or in the context of which the Muuvr website is used), your connection to MUUVR, or any breach by you of the terms, privacy and data protection laws, or the rights of any other natural or legal person.
4. MUUVS
4.1 Overview
MUUVS can be used as part of the products and services offered by MUUVR to provide discounts. MUUVS may grant access to exclusive products and services, guides, or sports training, "Money-can’t-buy" experiences, as well as special features in the MUUVR app like individual activity statistics and sweepstakes (see below in Sec. 4.4 for more details). MUUVS are solely for the purposes expressly listed or derived from these terms, additional applicable provisions, and the company’s notices.
You can check the current status of your accumulated MUUVS anytime on MUUVR when you’re logged in.
4.2 Transferability of MUUVS and Trading with MUUVS
MUUVS cannot be transferred to third parties. Trading MUUVS (whether through selling, swapping, auctioning, or any other form of passing them to third parties) is prohibited. Facilitating the trading of MUUVS and arranging the acquisition of MUUVS is also prohibited, as is the unauthorized use of MUUVS or benefits gained from them. Any different rules must be explicitly announced by the company.
4.3 Collecting MUUVS
Collecting MUUVS is possible once you start using MUUVR. You can gather MUUVS through personal sporting activities, by interacting with content from MUUVR partners, participating in contests, or through product transactions within the MUUVR partner network.
MUUVS can also be purchased for a monetary amount.
The number of credited MUUVS is based on the duration and intensity of the sporting activity, the volume of transactions in products and services within the MUUVR partner network, and other activities within the MUUVR app like participating in surveys.
Other temporary or permanent ways to collect MUUVS and the underlying regulations can be announced by the company at any time.
4.4 Redeem MUUVS
You can use your MUUVS alone or together with a payment method as follows (each is a "reward"):
Obtain discounted products, services, vouchers, or coupons within the MUUVR partner network
Participate in competitions, access functionalities, and exclusive offers within the MUUVR app
Register or participate in events, training sessions, instructions from coaches, or "money-can’t-buy" experiences
The availability of one or more rewards is not guaranteed, assured, or ensured at any time. You have no claim to redeem MUUVS for a specific reward during the validity of your MUUVS or thereafter.
MUUVS do not represent a claim against the company and particularly no claim for redemption or repayment by a reward or in cash. It is at the company's discretion if, how, and when MUUVS can be redeemed.

The terms for the general use or redemption of MUUVS can be adjusted by the company at any time with appropriate notice. By continuing to use MUUVR, you agree to an adjustment of the conditions.
4.5 Improper Collection or Acquisition
In the case of abusive collection or acquisition of MUUVS according to these provisions or misuse of the MUUVR app, MUUVS will not be credited, and the company reserves the right to delete collected MUUVS or refuse the redemption of wrongfully obtained MUUVS. Any rewards received through the redemption of unlawfully gained MUUVS may be blocked or reclaimed.
The right to terminate according to section 10.2, as well as the right to assert further claims against you, including compensation for damages, remains unaffected.
In the event that rewards obtained through abusive acquisition of MUUVS under your responsibility are requested or have been requested, the company reserves the right to demand compensation from you.
4.6 MUUVS Expiration
If MUUVS are not redeemed for a reward within 12 months from the date of crediting in the MUUVR app, they will expire the following day, unless the company has announced longer expiration periods.
You will be notified separately in the MUUVR app about the expiration of MUUVS before the respective expiration date.
The MUUVS are technically linked to the email address specified and verified in your MUUVR app, which you need access to at all times. If you install the MUUVR app on a new smartphone, the existing MUUVS will only be retained if you re-enter your profile with the previously verified email address. Otherwise, the MUUVS will be lost.
4.7 Fees, Surcharges, and Service Charges
All additional costs, such as taxes or fees related to collecting or using MUUVS, are your responsibility to cover.
Progress / Achievement Level
MUUVR lets you reach different levels. Each level is based on the number of MUUVS you collect within a given timeframe. Once the timeframe is over, the MUUVS count starts fresh.
From time to time, additional opportunities to reach a level might be offered. Each level comes with different perks. Detailed information about the qualification criteria, the duration of a level, and the associated benefits will be communicated by the company clearly.
5. Communication and Newsletter
By using MUUVR, you agree to receive updates on your MUUVS progress, your desired rewards, as well as offers and events from MUUVR through MUUVR or other communication channels. You can unsubscribe from these updates at any time.
6. Ownership
6.1 Owning Your MUUVR
The company owns all rights to MUUVR, including the rights to the software, technologies, and content provided on or through the platform.
You acknowledge and agree that MUUVR is protected by copyrights, trademarks, patents, and other laws of Switzerland and other countries.
6.2 Intellectual Property Rights
The brands, logos, and names of MUUVR (the “MUUVR-brands”) are owned by the company. You must not use the MUUVR-brands without the company's prior written permission.
6.3 Limitations on the Use of MUUVR's Property
You may not copy, change, distribute, sell, or rent any part of MUUVR, including the MUUVR trademarks, without prior written permission from the company. You must not reverse engineer or attempt to extract the source code of MUUVR, or any part of it.
The company reserves all rights not expressly granted to you in these terms. You acknowledge that any unauthorized use of MUUVR's property can cause irreparable damage, and the company may seek an injunction, along with other available legal remedies, to prevent such harm.
7. Compensation
7.1 Staying in Top Shape
You agree to indemnify, defend, and hold the company, as well as its respective officers, directors, board members, employees, agents, and representatives, harmless from and against any claims, liabilities, damages, losses, and expenses, including but not limited to reasonable attorneys' fees and costs, arising out of or in any way connected with your use of MUUVR, your user content, or your breach of these terms or applicable laws or regulations.
7.2 Scope of Compensation
Your indemnification obligations will survive any termination or expiration of these terms or your use of MUUVR. The company reserves the right to assume, at its own expense, the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you will cooperate with the company in asserting all available defenses.
7.3 Notification and Collaboration
You agree to promptly inform the company of any actual or threatened claims, lawsuits, or actions arising from your use of MUUVR or your user content, or related to it. You also agree to cooperate with the company in defending such claims, lawsuits, or actions.
The company reserves the right to assume the exclusive representation and control over any matter subject to indemnification by you, in which case you will cooperate with the company in asserting any claims.
8. Liability
8.1 Disclaimer of Warranties
MUUVR is provided to you without any warranties. The company specifically disclaims any express or implied warranties for MUUVR, including any warranties for functionality, merchantability, or fitness for a particular purpose.
The company is not liable for any data and information distributed on MUUVR, nor for any damages that may arise from it. This applies to all types of damages, especially those resulting from errors, delays, or interruptions in transmission, infrastructure disruptions, inaccurate content, loss or deletion of data, viruses, or other issues that may arise during the use of the platform.
The company does not guarantee uninterrupted access to MUUVR or a disturbance-free quality of access. The company can freely decide regarding availability and functionality during which periods MUUVR may not be accessible for technical reasons, improvements to offered services, or optimization of its usability. The company does not guarantee that MUUVR will function without interruptions or errors or that any errors will be corrected. Furthermore, the company does not guarantee that the contents of MUUVR are correct, complete, reliable, or up-to-date.
8.2 Limitation of Liability
The company is not liable on any legal grounds for direct or indirect damages that may occur to you from using MUUVR. Additionally, the company is not responsible for lost profits, data loss, or other intangible damages arising from either correct or incorrect use of MUUVR.
9. Change of Terms
9.1 Right to Change the Terms
The company reserves the right to change or update these terms at any time without prior notice. The company will publish the updated terms on MUUVR, and these terms will be effective from the date of publication unless stated otherwise.
9.2 Notification of Changes
The company can inform you about changes to these terms via email, through MUUVR, or in other ways. It's your responsibility to keep your contact information with MUUVR up to date to receive such notifications.
9.3 Continuing to use the service is your agreement to the changes
If you don't agree with the updated terms, you need to stop using MUUVR. By continuing to use MUUVR after the updated terms come into effect, you agree to the updated terms.
10. Conclusion
10.1 Right to Terminate or Suspend User Access
The company can terminate or suspend your access to MUUVR at any time and for any reason, including and without limitation, if you violate these terms or if the company at its sole discretion determines that your use of MUUVR poses a risk to the company or to MUUVR and its users.
In the case of abusive acquisition or collection of MUUVS, the company reserves the right to revoke a level granted due to wrongfully obtained MUUVS.
The right to termination stated below as well as the right to assert further claims against you including damages, remain unaffected.
10.2 Your Right to End the Agreement
You can cancel these terms at any time by stopping your use of MUUVR and deleting your account.
Consequences of Termination
When these terms end for any reason, all your granted licenses and rights will immediately expire, and you must stop using MUUVR right away. The following sections of these terms will survive any termination: 6. Ownership, 3.5. User Content, 8. Indemnity, 8.1. Disclaimers, 8.2. Limitation of Liability, 9. Changes to the Terms and Termination.
The company is not liable to you or any third party for terminating your access to MUUVR or deleting your user content.
11. Applicable Law and Jurisdiction
11.1 Applicable Law
These terms are governed by the substantive law of Switzerland and will be interpreted in accordance with it, without applying the principles of conflict of laws.
11.2 Resolving Disputes
The regular courts of the city of Zurich are responsible for any disputes, claims, or disagreements arising from or in connection with these terms or their breach, termination, enforcement, interpretation, or validity.
12. Miscellaneous
12.1 Separability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect and enforceable.
12.2 No Giving Up
MUUVR's failure to enforce a right or provision of these terms does not constitute a waiver of that right or provision.
12.3 Assignment
These terms and any rights and licenses granted here cannot be transferred or assigned by you, but may be transferred or assigned by MUUVR without any restrictions.

The company is not liable for any data and information distributed on MUUVR, nor for any damages that may arise from it. This applies to all types of damages, especially those resulting from errors, delays, or interruptions in transmission, infrastructure disruptions, inaccurate content, loss or deletion of data, viruses, or other issues that may arise during the use of the platform.
The company does not guarantee uninterrupted access to MUUVR or a disturbance-free quality of access. The company can freely decide regarding availability and functionality during which periods MUUVR may not be accessible for technical reasons, improvements to offered services, or optimization of its usability. Muuvr is available for both Android and Apple smartphones and can be connected to data collection devices and platforms, known as wearables, including Garmin, Apple, Google, Wahoo, and Whoop.
MUUVR accesses the user data from your respective wearable app. When installing the MUUVR app on your smartphone, you must give your consent for MUUVR to work as intended automatically. MUUVR only has access to the data you record on your wearable app. Please also carefully review our privacy policy, which forms an integral part of these terms.
Through athletic and other activities listed under section 4.3., you can collect points with MUUVR. Once the connection between the MUUVR app and your wearable app is established, the number of new MUUVS is continuously calculated. The company reserves the right to remove content that violates the law, good morals, or these terms. Furthermore, the company can pause or terminate your Muuvr app at any time or take other appropriate actions at its discretion if you violate the law, good morals, or these terms.

3.5 User Content
MUUVR lets you upload and share content, including but not limited to information, data, texts, software, sounds, photos, graphics, videos, messages, posts, tags, or other materials (“User Content”). By uploading User Content to MUUVR, you grant the company a non-exclusive, transferable, sublicensable, royalty-free, worldwide, unlimited license to use it in any way, particularly to copy, modify, distribute, publicly display, and create derivative works based on your User Content. You also give MUUVR the right to use, display, and distribute your User Content for providing and promoting the platform.
3.6 Ownership of User Content
You retain all ownership rights to your user content. The company does not claim any ownership rights to this content.
3.7 Assurance
By uploading user content to MUUVR, you declare and guarantee that:
you are the owner of the user content you provide in connection with MUUVR, whether it is publicly posted, privately transmitted, or submitted via a third-party API (e.g., a video submitted via Zwift), or you otherwise have the right to grant the rights and licenses set forth in these terms;
the user content does not infringe on the rights of third parties, especially their privacy rights;
the user content does not violate the law or public morals, and in particular, the user content is not defamatory, libelous, violent, racist, pornographic, or harmful to minors; and
the user content does not contain viruses or other harmful software.
You agree to indemnify the company, its board members, executive officers, agents, employees, partners, and licensors against any claims or demands made by a third party due to or arising out of the user content you provide over MUUVR, your use of MUUVR, your athletic activities from which the user content you publish on MUUVR now or in the future is generated (this includes, among other things, athletic activities as part of competitions, races, group rides, or other events sponsored or organized by MUUVR, in which MUUVR is involved, or in the context of which the Muuvr website is used), your connection to MUUVR, or any breach by you of the terms, privacy and data protection laws, or the rights of any other natural or legal person.
4. MUUVS
4.1 Overview
MUUVS can be used as part of the products and services offered by MUUVR to provide discounts. MUUVS may grant access to exclusive products and services, guides, or sports training, "Money-can’t-buy" experiences, as well as special features in the MUUVR app like individual activity statistics and sweepstakes (see below in Sec. 4.4 for more details). MUUVS are solely for the purposes expressly listed or derived from these terms, additional applicable provisions, and the company’s notices.
You can check the current status of your accumulated MUUVS anytime on MUUVR when you’re logged in.
4.2 Transferability of MUUVS and Trading with MUUVS
MUUVS cannot be transferred to third parties. Trading MUUVS (whether through selling, swapping, auctioning, or any other form of passing them to third parties) is prohibited. Facilitating the trading of MUUVS and arranging the acquisition of MUUVS is also prohibited, as is the unauthorized use of MUUVS or benefits gained from them. Any different rules must be explicitly announced by the company.
4.3 Collecting MUUVS
Collecting MUUVS is possible once you start using MUUVR. You can gather MUUVS through personal sporting activities, by interacting with content from MUUVR partners, participating in contests, or through product transactions within the MUUVR partner network.
MUUVS can also be purchased for a monetary amount.
The number of credited MUUVS is based on the duration and intensity of the sporting activity, the volume of transactions in products and services within the MUUVR partner network, and other activities within the MUUVR app like participating in surveys.
Other temporary or permanent ways to collect MUUVS and the underlying regulations can be announced by the company at any time.
4.4 Redeem MUUVS
You can use your MUUVS alone or together with a payment method as follows (each is a "reward"):
Obtain discounted products, services, vouchers, or coupons within the MUUVR partner network
Participate in competitions, access functionalities, and exclusive offers within the MUUVR app
Register or participate in events, training sessions, instructions from coaches, or "money-can’t-buy" experiences
The availability of one or more rewards is not guaranteed, assured, or ensured at any time. You have no claim to redeem MUUVS for a specific reward during the validity of your MUUVS or thereafter.
MUUVS do not represent a claim against the company and particularly no claim for redemption or repayment by a reward or in cash. It is at the company's discretion if, how, and when MUUVS can be redeemed.

The terms for the general use or redemption of MUUVS can be adjusted by the company at any time with appropriate notice. By continuing to use MUUVR, you agree to an adjustment of the conditions.
4.5 Improper Collection or Acquisition
In the case of abusive collection or acquisition of MUUVS according to these provisions or misuse of the MUUVR app, MUUVS will not be credited, and the company reserves the right to delete collected MUUVS or refuse the redemption of wrongfully obtained MUUVS. Any rewards received through the redemption of unlawfully gained MUUVS may be blocked or reclaimed.
The right to terminate according to section 10.2, as well as the right to assert further claims against you, including compensation for damages, remains unaffected.
In the event that rewards obtained through abusive acquisition of MUUVS under your responsibility are requested or have been requested, the company reserves the right to demand compensation from you.
4.6 MUUVS Expiration
If MUUVS are not redeemed for a reward within 12 months from the date of crediting in the MUUVR app, they will expire the following day, unless the company has announced longer expiration periods.
You will be notified separately in the MUUVR app about the expiration of MUUVS before the respective expiration date.
The MUUVS are technically linked to the email address specified and verified in your MUUVR app, which you need access to at all times. If you install the MUUVR app on a new smartphone, the existing MUUVS will only be retained if you re-enter your profile with the previously verified email address. Otherwise, the MUUVS will be lost.
4.7 Fees, Surcharges, and Service Charges
All additional costs, such as taxes or fees related to collecting or using MUUVS, are your responsibility to cover.
Progress / Achievement Level
MUUVR lets you reach different levels. Each level is based on the number of MUUVS you collect within a given timeframe. Once the timeframe is over, the MUUVS count starts fresh.
From time to time, additional opportunities to reach a level might be offered. Each level comes with different perks. Detailed information about the qualification criteria, the duration of a level, and the associated benefits will be communicated by the company clearly.
5. Communication and Newsletter
By using MUUVR, you agree to receive updates on your MUUVS progress, your desired rewards, as well as offers and events from MUUVR through MUUVR or other communication channels. You can unsubscribe from these updates at any time.

you are the owner of the user content you provide in connection with MUUVR, whether it is publicly posted, privately transmitted, or submitted via a third-party API (e.g., a video submitted via Zwift), or you otherwise have the right to grant the rights and licenses set forth in these terms;
the user content does not infringe on the rights of third parties, especially their privacy rights;
the user content does not violate the law or public morals, and in particular, the user content is not defamatory, libelous, violent, racist, pornographic, or harmful to minors; and
the user content does not contain viruses or other harmful software.
You agree to indemnify the company, its board members, executive officers, agents, employees, partners, and licensors against any claims or demands made by a third party due to or arising out of the user content you provide over MUUVR, your use of MUUVR, your athletic activities from which the user content you publish on MUUVR now or in the future is generated (this includes, among other things, athletic activities as part of competitions, races, group rides, or other events sponsored or organized by MUUVR, in which MUUVR is involved, or in the context of which the Muuvr website is used), your connection to MUUVR, or any breach by you of the terms, privacy and data protection laws, or the rights of any other natural or legal person.
4. MUUVS
4.1 Overview
MUUVS can be used as part of the products and services offered by MUUVR to provide discounts. MUUVS may grant access to exclusive products and services, guides, or sports training, "Money-can’t-buy" experiences, as well as special features in the MUUVR app like individual activity statistics and sweepstakes (see below in Sec. 4.4 for more details). MUUVS are solely for the purposes expressly listed or derived from these terms, additional applicable provisions, and the company’s notices.
You can check the current status of your accumulated MUUVS anytime on MUUVR when you’re logged in.
4.2 Transferability of MUUVS and Trading with MUUVS
MUUVS cannot be transferred to third parties. Trading MUUVS (whether through selling, swapping, auctioning, or any other form of passing them to third parties) is prohibited. Facilitating the trading of MUUVS and arranging the acquisition of MUUVS is also prohibited, as is the unauthorized use of MUUVS or benefits gained from them. Any different rules must be explicitly announced by the company.
4.3 Collecting MUUVS
Collecting MUUVS is possible once you start using MUUVR. You can gather MUUVS through personal sporting activities, by interacting with content from MUUVR partners, participating in contests, or through product transactions within the MUUVR partner network.
MUUVS can also be purchased for a monetary amount.
The number of credited MUUVS is based on the duration and intensity of the sporting activity, the volume of transactions in products and services within the MUUVR partner network, and other activities within the MUUVR app like participating in surveys.
Other temporary or permanent ways to collect MUUVS and the underlying regulations can be announced by the company at any time.
4.4 Redeem MUUVS
You can use your MUUVS alone or together with a payment method as follows (each is a "reward"):
Obtain discounted products, services, vouchers, or coupons within the MUUVR partner network
Participate in competitions, access functionalities, and exclusive offers within the MUUVR app
Register or participate in events, training sessions, instructions from coaches, or "money-can’t-buy" experiences
The availability of one or more rewards is not guaranteed, assured, or ensured at any time. You have no claim to redeem MUUVS for a specific reward during the validity of your MUUVS or thereafter.
MUUVS do not represent a claim against the company and particularly no claim for redemption or repayment by a reward or in cash. It is at the company's discretion if, how, and when MUUVS can be redeemed.

The terms for the general use or redemption of MUUVS can be adjusted by the company at any time with appropriate notice. By continuing to use MUUVR, you agree to an adjustment of the conditions.
4.5 Improper Collection or Acquisition
In the case of abusive collection or acquisition of MUUVS according to these provisions or misuse of the MUUVR app, MUUVS will not be credited, and the company reserves the right to delete collected MUUVS or refuse the redemption of wrongfully obtained MUUVS. Any rewards received through the redemption of unlawfully gained MUUVS may be blocked or reclaimed.
The right to terminate according to section 10.2, as well as the right to assert further claims against you, including compensation for damages, remains unaffected.
In the event that rewards obtained through abusive acquisition of MUUVS under your responsibility are requested or have been requested, the company reserves the right to demand compensation from you.
4.6 MUUVS Expiration
If MUUVS are not redeemed for a reward within 12 months from the date of crediting in the MUUVR app, they will expire the following day, unless the company has announced longer expiration periods.
You will be notified separately in the MUUVR app about the expiration of MUUVS before the respective expiration date.
The MUUVS are technically linked to the email address specified and verified in your MUUVR app, which you need access to at all times. If you install the MUUVR app on a new smartphone, the existing MUUVS will only be retained if you re-enter your profile with the previously verified email address. Otherwise, the MUUVS will be lost.
4.7 Fees, Surcharges, and Service Charges
All additional costs, such as taxes or fees related to collecting or using MUUVS, are your responsibility to cover.
Progress / Achievement Level
MUUVR lets you reach different levels. Each level is based on the number of MUUVS you collect within a given timeframe. Once the timeframe is over, the MUUVS count starts fresh.
From time to time, additional opportunities to reach a level might be offered. Each level comes with different perks. Detailed information about the qualification criteria, the duration of a level, and the associated benefits will be communicated by the company clearly.
5. Communication and Newsletter
By using MUUVR, you agree to receive updates on your MUUVS progress, your desired rewards, as well as offers and events from MUUVR through MUUVR or other communication channels. You can unsubscribe from these updates at any time.
6. Ownership
6.1 Owning Your MUUVR
The company owns all rights to MUUVR, including the rights to the software, technologies, and content provided on or through the platform.
You acknowledge and agree that MUUVR is protected by copyrights, trademarks, patents, and other laws of Switzerland and other countries.
6.2 Intellectual Property Rights
The brands, logos, and names of MUUVR (the “MUUVR-brands”) are owned by the company. You must not use the MUUVR-brands without the company's prior written permission.
6.3 Limitations on the Use of MUUVR's Property
You may not copy, change, distribute, sell, or rent any part of MUUVR, including the MUUVR trademarks, without prior written permission from the company. You must not reverse engineer or attempt to extract the source code of MUUVR, or any part of it.
The company reserves all rights not expressly granted to you in these terms. You acknowledge that any unauthorized use of MUUVR's property can cause irreparable damage, and the company may seek an injunction, along with other available legal remedies, to prevent such harm.
7. Compensation
7.1 Staying in Top Shape
You agree to indemnify, defend, and hold the company, as well as its respective officers, directors, board members, employees, agents, and representatives, harmless from and against any claims, liabilities, damages, losses, and expenses, including but not limited to reasonable attorneys' fees and costs, arising out of or in any way connected with your use of MUUVR, your user content, or your breach of these terms or applicable laws or regulations.
7.2 Scope of Compensation
Your indemnification obligations will survive any termination or expiration of these terms or your use of MUUVR. The company reserves the right to assume, at its own expense, the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you will cooperate with the company in asserting all available defenses.
7.3 Notification and Collaboration
You agree to promptly inform the company of any actual or threatened claims, lawsuits, or actions arising from your use of MUUVR or your user content, or related to it. You also agree to cooperate with the company in defending such claims, lawsuits, or actions.
The company reserves the right to assume the exclusive representation and control over any matter subject to indemnification by you, in which case you will cooperate with the company in asserting any claims.
8. Liability
8.1 Disclaimer of Warranties
MUUVR is provided to you without any warranties. The company specifically disclaims any express or implied warranties for MUUVR, including any warranties for functionality, merchantability, or fitness for a particular purpose.
The company is not liable for any data and information distributed on MUUVR, nor for any damages that may arise from it. This applies to all types of damages, especially those resulting from errors, delays, or interruptions in transmission, infrastructure disruptions, inaccurate content, loss or deletion of data, viruses, or other issues that may arise during the use of the platform.
The company does not guarantee uninterrupted access to MUUVR or a disturbance-free quality of access. The company can freely decide regarding availability and functionality during which periods MUUVR may not be accessible for technical reasons, improvements to offered services, or optimization of its usability. The company does not guarantee that MUUVR will function without interruptions or errors or that any errors will be corrected. Furthermore, the company does not guarantee that the contents of MUUVR are correct, complete, reliable, or up-to-date.
8.2 Limitation of Liability
The company is not liable on any legal grounds for direct or indirect damages that may occur to you from using MUUVR. Additionally, the company is not responsible for lost profits, data loss, or other intangible damages arising from either correct or incorrect use of MUUVR.
9. Change of Terms
9.1 Right to Change the Terms
The company reserves the right to change or update these terms at any time without prior notice. The company will publish the updated terms on MUUVR, and these terms will be effective from the date of publication unless stated otherwise.
9.2 Notification of Changes
The company can inform you about changes to these terms via email, through MUUVR, or in other ways. It's your responsibility to keep your contact information with MUUVR up to date to receive such notifications.
9.3 Continuing to use the service is your agreement to the changes
If you don't agree with the updated terms, you need to stop using MUUVR. By continuing to use MUUVR after the updated terms come into effect, you agree to the updated terms.
10. Conclusion
10.1 Right to Terminate or Suspend User Access
The company can terminate or suspend your access to MUUVR at any time and for any reason, including and without limitation, if you violate these terms or if the company at its sole discretion determines that your use of MUUVR poses a risk to the company or to MUUVR and its users.
In the case of abusive acquisition or collection of MUUVS, the company reserves the right to revoke a level granted due to wrongfully obtained MUUVS.
The right to termination stated below as well as the right to assert further claims against you including damages, remain unaffected.
10.2 Your Right to End the Agreement
You can cancel these terms at any time by stopping your use of MUUVR and deleting your account.
Consequences of Termination
When these terms end for any reason, all your granted licenses and rights will immediately expire, and you must stop using MUUVR right away. The following sections of these terms will survive any termination: 6. Ownership, 3.5. User Content, 8. Indemnity, 8.1. Disclaimers, 8.2. Limitation of Liability, 9. Changes to the Terms and Termination.
The company is not liable to you or any third party for terminating your access to MUUVR or deleting your user content.
11. Applicable Law and Jurisdiction
11.1 Applicable Law
These terms are governed by the substantive law of Switzerland and will be interpreted in accordance with it, without applying the principles of conflict of laws.
11.2 Resolving Disputes
The regular courts of the city of Zurich are responsible for any disputes, claims, or disagreements arising from or in connection with these terms or their breach, termination, enforcement, interpretation, or validity.
12. Miscellaneous
12.1 Separability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect and enforceable.
12.2 No Giving Up
MUUVR's failure to enforce a right or provision of these terms does not constitute a waiver of that right or provision.
12.3 Assignment
These terms and any rights and licenses granted here cannot be transferred or assigned by you, but may be transferred or assigned by MUUVR without any restrictions.
